Section 13
Disqualification of candidates
Notwithstanding anything contained elsewhere in this Act, the following persons shall be deemed to be disqualified from being candidates for election:-
(a) Not qualified under section 12,
(b) Non-Nepali citizens,
(c) Government of Nepal, State Government and Government of Nepal or owned or controlled by the State Government or receiving remuneration from an organization receiving subsidy from the Government of Nepal,
(d) any local level or owned or controlled by the local level or held for remuneration in an organization receiving grants from the local level Explanation: For the purposes of this section, "local level" means a village development committee, municipality or district in existence at the time of commencement of this Act; It also refers to the development committee.
(e) Has not paid for two years from the date of serving such punishment after being punished according to the prevailing laws related to elections,
(f) Convicted of corruption, extortion, human trafficking and trafficking, sale, distribution and exportation or importation of narcotic drugs, money laundering, passport misuse, kidnapping or any other criminal offense of moral turpitude or imprisonment for life or twenty years or more for any offence. Imprisonment sentence is final,
(g) Sentenced to imprisonment for an offense related to organized crime, or sentenced to imprisonment for less than twenty years for an offense related to duty, and six years have not passed from the date of payment of such sentence,
(h) Sentenced to imprisonment for crimes related to caste discrimination and untouchability, witchcraft or polygamy, not having completed three years from the date of serving such sentence,
(i) having been sentenced to imprisonment for five years or more for offenses other than those mentioned in clauses (f) and (g) and not having completed six years from the date of serving such sentence,
(j) For being blacklisted according to the prevailing law, throughout that period (k) for imprisonment throughout the period of imprisonment,
(l) Mental balance is not right,
(d) Being disqualified by prevailing law.
